Terms of Service

The terms under which merchants use the Buya platform.

1. The service

Buya, operated by Pot Labs (Pty) Ltd ("we"), provides a loyalty, order-ahead and customer-intelligence engine, a branded customer app and Merchant Centre, and an optional headless API. By creating a merchant account you ("the merchant") agree to these terms.

2. Accounts & access

You're responsible for the accuracy of the details you provide, for activity under your account, and for keeping your login and any API keys secure. You must have authority to bind your business.

3. Your data, your customers

The customer list and data collected through your Buya app belong to you. You can export it at any time. We process it only to provide the service and on your instruction, as set out in our Privacy & POPIA policy. As the responsible party for that data, you're responsible for having a lawful basis and the right customer notices in place.

5. Fees

Subscription fees, tiers and any usage charges are as quoted to you and are currently proposed and adjustable during onboarding. Fees are billed in advance; taxes are additional where applicable. We'll give reasonable notice of price changes.

6. Availability

We work to keep Buya reliable but the service is provided "as is" during this early stage, without warranties of uninterrupted or error-free operation. We may update, improve or change features over time.

7. Liability

To the extent permitted by law, neither party is liable for indirect or consequential loss, and our total liability for any claim is limited to the fees you paid us in the three months before the claim. Nothing here limits liability that cannot be limited by law.

8. Suspension & termination

Either party may end the service on reasonable notice. We may suspend an account for non-payment, a material breach, or to protect the platform or other merchants. On termination you can export your data before it is deleted or de-identified.

9. Governing law

These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.
